Bankruptcy is often misunderstood by the general public, and considered to be a bad thing done only by bad people in a desperate situation. However, often this is not the situation. The consumer is usually an honest, hard-working person, and is sometimes hit with a serious financial challenge caused by one of a number of things. Health problems, unemployment, divorce and theft are examples. Still some consumers have the best of intentions, but are not able to properly manage their financial situation.

If you are involved in a serious financial challenge, you may be considering all of your options to deal with the problem. Most people are aware that there are credit counseling and debt repair services out there, and some people, but not many, successfully use a credit counseling or debt repair service to fix their problems. Beware, while most of these services are legitimate, there are some out there that are only intending to separate you from your money. For many people involved in a serious financial challenge, bankruptcy may be the only alternative. I have helped many consumers obtain a fresh start on their finances, through Chapter 7 and Chapter 13 bankruptcy cases. In addition, I offer the service of properly evaluating your situation, and only recommending bankruptcy if there are no other alternatives. I have often advised clients that bankruptcy for their situation can be done, but that alternatives such as credit counseling and debt repair might be better for them. I will do this for you.

There are a number of advantages to doing bankruptcy. Bankruptcy can help you to:

  • Stop the repossession of your car or other secured property.
  • Stop the foreclosure of your home.
  • Stop the garnishment of your bank account or pay.
  • Eliminate judgments that are filed against you.
  • Catch up on your alimony and child support payments.
  • Catch up on mortgage payments and car loan payments.
  • Resolve tax problems with the IRS, State of New Jersey, or your town.
These advantages are examples and all go to the underlying principle behind the bankruptcy laws, namely to help you eliminate or reduce your debt, and give you a fresh start on your finances.

In 2005 the federal government adopted changes to the bankruptcy laws which made significant changes to the system of filing bankruptcy petitions. Prior to the effective date of these changes, some bankruptcy attorneys advertised to the public that anyone with financial problems must file for bankruptcy immediately, because they may be not be eligible after the effective date of the new changes, October 17, 2005. Many people with debt problems became upset and immediately filed for bankruptcy. After October 17, 2005, people with debt problems did not consider bankruptcy because they believe that the system was no longer available to them. The truth is that the system has been changed and made more complicated for the bankruptcy attorney, but most people who would qualify to do a bankruptcy filing prior to October 17, 2005, are still eligible. Only recently has the general public become aware that the new bankruptcy laws are available for them. As the result, bankruptcy filings have increased.

I began filing bankruptcy petitions in the late 1980s. My bankruptcy practice is limited to Chapter 7 filings for consumers and small businesses, and Chapter 13 filings for consumers. The bankruptcy laws are complicated, and I have always believed that I would perform a better service to my clients by limiting my practice to a concentrated area.
